Terms of Use for SprintFall App

1. Scope and Contract Formation

1.1 Area of Application

These Terms of Use (hereinafter "Terms") govern the use of the mobile application "SprintFall" (hereinafter "App") between you as a user and us as the provider.

1.2 Contract Formation

The contract is formed by:

Downloading the App from the App Store or Google Play Store
Accepting the consent declaration on first launch
Continued use of the App after acceptance

1.3 Minimum Age

The App is suitable for persons aged 12 and above (USK 0). Minors under 18 require parental consent.

2. Service Description

2.1 App Features

SprintFall is a free jump'n'run game with the following features:

Gameplay: Endless jumping game with increasing difficulty
Character System: 9 unlockable skins (incl. event characters)
Currency System: In-game coins (no real money purchases)
Achievement System: 25 quests and achievements
Leaderboard: Online highscore list (optional, with consent)
Cloud Backup: 24-hour backup codes for save game protection
Events: Time-limited special events (Halloween, Welcome, Weekend Dino)
Daily Rewards: Coins through video ads

2.2 Technical Requirements

iOS: Version 12.0 or higher
Android: Version 5.0 (API Level 21) or higher
Storage: Approx. 100 MB
Internet: Optional (only for leaderboard and cloud backup)

2.3 Availability

The App works completely offline. Online features (leaderboard, cloud backup) require an internet connection. We do not guarantee 100% availability of online services.

3. Usage Rights and Licenses

3.1 License Grant

We grant you a personal, non-exclusive, non-transferable, revocable license for private use of the App on your personal devices.

3.2 Restrictions

You may NOT:

Decompile, reverse-engineer, or modify the App
Bypass or disable security measures
Use the App for commercial purposes
Use automated tools, bots, or cheats
Manipulate the Firebase database or Unity Ads integration
Distribute malware or perform DDoS attacks
Create multiple accounts per person

3.3 Intellectual Property

All rights to the App belong to us:

Flutter source code and program logic
Graphics, sprites, and animations
Sound and music files
Game mechanics and level design
SprintFall brand and logo

4. Game Rules and Code of Conduct

4.1 Player Name (3-12 characters)

Your player name is checked by an automatic profanity filter (DE/EN/TR). Prohibited are:

Offensive or discriminatory terms
Sexual or violent content
Hate speech or extremist symbols
Advertising or commercial content
Impersonation of other players or celebrities
Trademark violations

4.2 Leaderboard Integrity

Only legitimate, self-earned points
Maximum one entry per player
Automatic filtering of invalid scores (e.g., 9999)
12-month retention, then automatic deletion
Visibility can be disabled at any time

4.3 Prohibited Activities

Strictly prohibited:

Cheating: Memory hacks, speed hacks, score manipulation
Exploiting: Using bugs for unfair advantages
Data mining: Extracting protected game content
Account trading: Selling or trading game saves
Harassment: Stalking other players via the leaderboard

5. Virtual Goods and In-Game Currency

5.1 Coin System

Coins are earned only through gameplay (1 coin per platform)
Additional coins through achievements and events
Daily coins through voluntary video ads
NO in-app purchases or real money transactions

5.2 Character Skins

2 free base skins (Standard Jumper, Women Power)
7 unlockable skins (50-1000 coins)
Event skins only available during active events
Once unlocked, permanently available

5.3 No Monetary Value

Virtual goods have no real monetary value and cannot be:

Exchanged for real money
Transferred to other accounts
Used outside the App

6. Advertising (Unity Ads)

6.1 Rewarded Ads

Ads are shown only at your initiative:

Revival: Once per game after game over
Daily Coins: Available once daily
Format: 15-30 second video ads
Reward: Immediately after complete viewing

6.2 Personalization

iOS: After App Tracking Transparency (ATT) consent
Android: Controllable via Google ad settings
Without consent: Only non-personalized ads

6.3 No Liability for Ad Content

We assume no responsibility for content from external advertisers.

7. Cloud Backup System

7.1 Functionality

Generation of a 6-character alphanumeric code
Storage in Firebase for 24 hours
Single use (code deleted after use)
Complete restoration of all game progress

7.2 Responsibility

You are responsible for:

Secure storage of the backup code
Timely use within 24 hours
Keeping the code secret

8. Privacy and Security

8.1 Privacy

Details on data processing can be found in our separate Privacy Policy.

8.2 Security Measures

TLS/HTTPS encryption for all transmissions
Firebase Security Rules for access control
Automatic score validation
Profanity filter in three languages

8.3 Reporting Security Issues

Please report security issues confidentially to support@sprintfall.de.

9. Liability and Warranty

9.1 Disclaimer

The App is provided "as is". We are liable only for intent and gross negligence. Excluded is liability for:

Data loss due to device defects
Incompatibility with certain devices
Server failures or network problems
Loss of virtual goods

9.2 Force Majeure

No liability in case of force majeure, particularly:

Natural disasters
Third-party cyber attacks
Government orders
Pandemic-related restrictions

10. Sanctions and Blocking

10.1 Immediate Measures

For violations, we may:

Delete leaderboard entries
Reset player names
Disable cloud backup function
Completely block access to the App

10.2 Reasons for Blocking

Cheating or manipulation
Repeated violations of name rules
Technical attacks on our servers
Abuse of backup function

10.3 Appeal

Appeal within 14 days to support@sprintfall.de with justification.

11. Termination

11.1 Termination by You

At any time by uninstalling the App
Delete all data via "Settings" > "Delete Game Data"
Disable leaderboard participation

11.2 Termination by Us

Without notice for serious violations
With 30 days notice if discontinuing App operation

11.3 Consequences

After termination:

No more access to online features
Automatic deletion of leaderboard entries after 12 months
No refund for virtual goods

12. Updates and Changes

12.1 App Updates

Regular updates via App Stores
New features and bug fixes
Compatibility with new OS versions

12.2 Terms Changes

Notification via in-app message
30-day objection period for material changes
Continued use constitutes acceptance

13. Final Provisions

13.1 Applicable Law

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods.

13.2 Jurisdiction

Jurisdiction is Bayreuth, Germany (for entrepreneurs).

13.3 Severability Clause

If individual provisions are invalid, the remaining provisions remain valid.

13.4 Dispute Resolution

The EU Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr

We are not obligated to participate in dispute resolution proceedings before consumer arbitration boards.
